										<content:encoded><![CDATA[<p>Expanding the scope of an earlier Supreme Court ruling allowing women to seek dissolution of marriage on account of &#8220;cruelty&#8221; by their husband or his family, the Peshawar High Court (PHC) has declared that besides physical violence against women by their husbands, mental, moral, and psychological torture is also tantamount to cruelty in such cases.</p>
<p>Justice Shahid Khan of a single-member bench ruled this while hearing a petition filed by a female cancer patient against the dissolution of her marriage.</p>
<p>Initially, the woman had filed a lawsuit for the dissolution of her marriage on basis of cruelty in a trial court. The trial court (family court) had accepted the woman&#8217;s plea and had ordered the ex-husband to pay the dower amount as well as past maintenance from June 2018 to the completion of the ex-wife&#8217;s iddat period. The court had also ordered the recovery of Rs500,000 on account of medical expenses as requested by the woman.</p>
<p><a href="https://www.dawn.com/news/1749321/phc-declares-mental-torture-cruelty-in-divorce-cases">Dawn</a> reported, the woman had maintained that she got married in 2018 and after four months of the marriage she was diagnosed with breast cancer. She had accused her husband of physical, mental, and psychological torture. However, the ex-husband denied the claims and challenged the verdict in a North Waziristan appellate court, which partially accepted it and dissolved the marriage on the basis of khula and not cruelty.</p>
<p>However, both the woman and her ex-husband appealed the verdict in the high court.</p>
<p>Justice Shahid Khan set aside the North Waziristan appellate court&#8217;s verdict that terminated the couple’s marriage on the basis of khula and not cruelty.</p>
<p>The court observed that the husband&#8217;s attitude was not cordial with his wife since the beginning of the marriage, adding according to the evidence presented, the man also never accompanied his wife during her clinical investigation.</p>
<p>It also observed that the man&#8217;s attitude was rather unbelievable, improper, and indecent, considering that he knew that his wife was suffering from an incurable disease and has a thin chance of survival.</p>
<p>“Due love and affection is the inherent right of the wife,&#8221; it observed.</p>
<p>The court ruled that the appellate court made a mistake by not dissolving the marriage on the basis of cruelty from the husband, whereas the conclusion of the trial court to dissolve the marriage tie on the ground of cruelty was well found.</p>

<p>The suspects sprinkled petrol on the woman&#8217;s body and set it on fire.</p>
<p>The identity of the deceased woman is yet to be ascertained.</p>
<p>Pakistan is often ranked among the worst countries for women&#8217;s security.</p>
<p>According to the global gender gap index 2022, out of 146 countries, Pakistan ranked 145th, with a growth of only 0.008 since 2021, and due to the lack of a support system, financial dependency, and victim blaming, one out of two Pakistani women do not report violence committed against them.</p>
<p class="">Earlier, the National Commission for Human Rights (NCHR) had revealed 40% of women in Pakistan — as per studies — have experienced physical or emotional violence in their lifetime.</p>
<p class="">Meanwhile, divorced, widowed, and separated women suffered more violence than married women.</p>
<p>Not to mention, &#8216;honour&#8217; killing has also been a common practice in Pakistan, despite legal reforms. Both international and Pakistani activists and activist groups have pushed for an end to the practice.</p>
<p>The Human Rights Commission of Pakistan listed 460 cases of reported &#8216;honour&#8217; killings in 2017, with 194 male and 376 females as victims.<sup id="cite_ref-:3_16-0" class="reference"></sup> Of these murders, 253 were sparked by the disapproval of illicit relations and 73 by the disapproval of marriage choice. Human rights activists claim that the number is much higher.<sup id="cite_ref-:3_16-1" class="reference"></sup></p>

										<content:encoded><![CDATA[<p>In a significant milestone for women&#8217;s representation in Pakistan&#8217;s judiciary, Khyber Pakhtunkhwa is all set to have its first woman chief justice.</p>
<p>Justice Mussarat Hilali will resume the charge of the Peshawar High Court Chief Justice as two senior judges of the high court are set to retire in March.</p>
<p>The judges who are set to retire include PHC Chief Justice Qaiser Rashid, who is also a member of the Supreme Judicial Council (SJC), and Roohul Amin Khan.</p>
<p>Justice Mussarat Hilali is likely to resume the charge of the high court chief justice in April till August 7 when she is expected to retire,<a href="https://tribune.com.pk/story/2408380/k-p-all-set-to-have-first-woman-chief-justice"> <em>Express Tribune</em> </a>reported.</p>
<p>According to her profile information given on the <a href="https://peshawarhighcourt.gov.pk/app/site/67/c/Profile_Justice_Mussarat_Hilali.html#">website</a> of the Peshawar High Court, Justice Mussarat Hilali received her law degree from Khyber Law College Peshawar University and enrolled as an advocate of district courts in 1983; as an advocate of the high court in 1988 and enrolled as an advocate of Supreme Court of Pakistan in 2006.</p>
<p>She was also the first woman additional advocate general of Khyber Pakhtunkhwa when she resumed the charge in November 2001 which lasted until March 2004.  She was also the first woman appointed as Chairperson Khyber Pakhtunkhwa Environmental Protection Tribunal.</p>
<p style="text-align: left;">In 2018, Justice Tahira Safdar became the first woman in Pakistan to take charge as a high court chief justice when she was nominated by then-chief justice of Pakistan Saqib Nisar as chief justice of the Balochistan High Court.</p>

										<content:encoded><![CDATA[<p>Police have recovered the body parts of an unidentified woman from the bank of Leh Nullah, Rawalpindi.</p>
<p>According to the details, a passerby spotted the body parts stuffed in shopping bags lying on the bank of the nullah and informed the police.</p>
<p>Police officials have said that nails and feet suggest that the victim is a woman. However, the officials are yet to establish the deceased&#8217;s identity.</p>
<p>An autopsy is being carried out at District Headquarters (DHQ) hospital.</p>
<p>Pakistan often ranks among the worst country for women’s security.</p>
<p>Earlier, a nine-year-old disabled child was found raped and murdered in Karachi’s Korangi area.</p>
<p>The police arrested two people during the investigation.</p>
<p>According to <a href="https://www.dawn.com/news/1741622?ref=notification"><em>Dawn</em></a>, the body of the boy was found in the rear seat of a parked Suzuki Cultus car. The police also said that they have arrested the owner of the vehicle and watchman of the parking stand for the investigation.</p>
<p>According to doctors, the boy had a right-hand deformity and during the medical examination, multiple injuries were found all over the body. The findings also suggested anal sexual abuse.</p>
<p>Doctors confirmed murder after rape in their preliminary findings.</p>
<p>In another incident, a six-year-old girl was found raped and murdered in the Bin Qasim area, Karachi.</p>
<p>According to the medical examination, the girl was brutally raped and then murdered. The girl’s body was recovered from a drain near National Highway.</p>
<p>The girl had gone missing while playing outside her home three days ago and the family had lodged a complaint at a police station.</p>
